Terms of Service

Effective date: October 16, 2026

1. Who we are and what we do

These terms cover tix.tooq.ca and any site we run on the same software (the Service). The Service is operated by Tooq Inc., Edmonton, Alberta, Canada (we, us).

We provide ticketing for artists, venues, festivals and other event organizers (Organizers). The Organizer puts on the event, sets the ticket prices and is responsible for the event itself. We are not the Organizer of any event unless we say so on the event page.

There are two ways an Organizer can be paid:

  • Paid through their own Stripe account. The Organizer is the seller. Your payment goes to the Organizer's Stripe account, and we receive our fees from that payment. Your receipt shows the Organizer as the seller.
  • Paid through us. We sell the tickets as the Organizer's agent, collect the payment and pay the Organizer after deducting our fees.

The event page and your receipt show which applies. In both cases these terms apply to your use of the Service.

2. Accounts

  • You need to be at least the age of majority in your province to buy tickets or create an account. Some events have their own age limits, shown on the event page, and you may be asked for ID at the door.
  • Keep your sign-in details private. You're responsible for what happens under your account.
  • Give us accurate details, including an email address you can receive tickets at.
  • Organizers and their team members (box office, door staff, crew coordinators) must use their own accounts. Don't share a sign-in.

3. Buying tickets

Prices and fees. The ticket price shown includes our service fee, our platform fee and card processing. Sales tax (GST, HST, PST or QST, depending on where the event is) is added at checkout when the Organizer charges it. The total you pay is shown before you pay.

Payment. Card payments are handled by Stripe. We never see or store your full card number.

Your tickets. Tickets are sent by email and are also on your order page. Each ticket has a unique QR code that admits one person once. Anyone holding a copy of the code can use it first, so don't post it publicly. We aren't responsible for tickets you share, lose or post.

Limits. Organizers can limit how many tickets one person buys. Orders that break a limit, or that look automated or fraudulent, may be cancelled and refunded.

Named tickets. For some events the ticket holder's name must match their ID at the door.

Free registrations. Some events have free tickets. They follow these terms too, except there's nothing to pay or refund.

Sending a ticket to someone. Where the Organizer allows it, you can transfer a ticket to another person. Once they accept, the old code stops working and they get a new one.

Fan-to-fan resale. Where the Organizer allows it, you can list a ticket for resale at face value. If it sells, your original ticket is cancelled, the buyer gets a new one, and you're refunded as described when you list it. Reselling above face value or on other sites may be refused by the Organizer.

Waitlists. For sold-out events you can join a waitlist. A ticket that comes back is offered to the next person for a limited time.

At the door. The Organizer and venue decide entry, including age checks, bag checks and conduct. A ticket can be cancelled without refund if you break the venue's or Organizer's rules. Cash sales at the door are made by the Organizer.

Your email updates. By buying, you agree to receive your tickets by email, along with updates about the event: changes to the lineup, date, time or venue, and cancellations. These are information, not marketing, so you can't opt out of them while you hold a ticket. News and offers are separate and only sent if you ask for them (see our Privacy Policy).

4. Event changes, cancellations and refunds

Refunds are covered by our Refund Policy, which is part of these terms. In short: if an event is cancelled you get your money back; if it's postponed or moved, your ticket stays valid and you may be able to ask for a refund within a set time; otherwise tickets aren't refundable, but you may be able to transfer or resell them.

The Organizer is responsible for the event and for refunds of the ticket price. When the Organizer is paid through their own Stripe account, refunds come from them. We help process refunds, but we can't refund money the Organizer has already been paid unless they agree or the law requires it.

5. For Organizers

If you sell tickets on the Service, these extra terms apply.

Your events. You're responsible for your events: putting them on as described, the venue, permits, insurance, safety, accessibility, age rules, and everything you publish (titles, descriptions, images and their descriptions). You confirm you have the rights to the content and images you upload. We may refuse, pause or remove an event that breaks these terms or the law.

An inclusive space. This Service is for everyone. We don't host or sell tickets for events, acts or content that promote hatred, intolerance or discrimination against people based on race, religion, ethnic or national origin, colour, gender, gender identity or expression, sexual orientation, age, disability or any other protected ground; that incite or glorify violence; or that harass, threaten or demean others. The same goes for how Organizers and their teams treat buyers, staff, artists and each other. We decide what falls under this. We may refuse, pause or remove any event, page or account at any time and for any reason, including reports from the public. If we remove an event that has sold tickets, buyers are refunded and the Organizer is responsible for those refunds under our Refund Policy.

Approval. Some events, free admission and fee waivers need our approval before they go on sale.

Fees. Our service fee, platform fee and any credential fee are set out in your plan and shown in your dashboard before you publish. They're built into your ticket price. Card processing is charged by Stripe. The fees on a ticket are fixed when it's sold. We may change our fees for future sales with notice sent via email.

Getting paid.

  • Through your own Stripe account: you're the seller and merchant of record. Stripe pays you directly and deducts its fees; our fees, plus GST/HST on them, are taken from each payment. You're responsible for your Stripe account, payouts, disputes and chargebacks.
  • Through us: we collect ticket money as your agent and pay you after the event, less fees, refunds and chargebacks, as set out in your statement. Payout within 10 business days after the event.

Paying Us. You agree to pay our invoices within 7 days of issuance. Invoices are sent via email and can be paid online with service fees if paying by credit card. Interac e-Tranfers are preferred and incur no extra fees.

Taxes. You're responsible for charging and remitting sales tax on your tickets if you're registered. We charge GST/HST on our own fees.

Refunds. You agree to follow our Refund Policy, including refunding buyers when your event is cancelled. If we refund buyers on your behalf, you agree to repay those amounts and we may deduct them from money we owe you.

Crew and volunteer passes. If your plan includes a credential fee, we invoice it after the event for passes issued and not cancelled before it starts.

Door, cash and printed tickets. Cash you collect at the door or through advance sellers is yours to account for. Our fees on those tickets are invoiced or deducted as shown in your statement.

Your team. You control who's on your team and what they can do, and you're responsible for their actions.

Attendee information. You receive buyers' names, and for some events their emails, only to run your event (entry, updates, refunds). Don't use it for anything else. Marketing is only allowed to people on your fan mailing list (section 6).

Your own page. Your public page, embed code and listing choices are yours to use; we may still list your events where they can be found by buyers unless you or your plan keep them off the main list.

6. Fan mailing lists

When a buyer chooses to share their email with you at checkout, you receive it only to send them your own news and announcements. You agree to: follow your published privacy policy; include your name, a mailing address and a working unsubscribe link in every message; stop emailing anyone who unsubscribes within 10 business days; not sell, rent or share the list, or use it for anyone else's promotions; keep it secure and delete it on request. You are responsible for your own compliance with Canada's Anti-Spam Legislation and privacy laws. We may remove your access to mailing lists if these terms are broken.

You can't see or export your list until you've given us a link to your privacy policy (or written a basic one on the Service) and agreed to these terms in your dashboard.

7. Using the Service

Don't: use bots or scripts to buy tickets; get around purchase limits, queues or codes; resell tickets above face value where the Organizer forbids it; copy or forge tickets; interfere with the Service or other people's use of it; upload anything unlawful or that you don't have the rights to. We may block access, cancel orders (with a refund of what was paid) or close accounts that do.

Photos and filming at events. Events are often photographed, filmed, recorded or streamed by the Organizer, the venue, the artists, media or other guests. By attending, you agree that you may appear in those photos, videos and recordings, and that they may be used to promote the event, the artists and future events, without payment to you. If you'd rather not be featured, tell event staff and avoid areas marked for filming; we can't guarantee you won't appear in the crowd. Organizers are responsible for following the law and posting notices where filming happens, and for getting a parent's or guardian's consent before featuring a child. Your own photos and recordings are subject to the venue's and artists' rules, which may ban cameras or recording.

Code of conduct at events. Everyone deserves a safe, good night. At every event, ticket holders agree to:

  • treat other guests, artists, staff and volunteers with respect; harassment, discrimination, threats and violence aren't tolerated;
  • respect people's boundaries and consent, on and off the dance floor;
  • follow instructions from venue staff, security and event crew, including on safety, capacity and emergencies;
  • follow the venue's rules and the law, including on alcohol, drugs, weapons and age limits;
  • not record or stream where the artist or venue asks you not to;
  • look out for each other and tell staff if someone needs help or is being made to feel unsafe.

The Organizer, venue or security may refuse entry or remove anyone who breaks this code or the venue's rules, without a refund. Organizers can post their own, stricter code on the event page, and it applies too.

8. Responsibility and liability

  • The Organizer is responsible for the event. We're responsible for running the Service with reasonable care.
  • The Service is provided as it is. We don't promise it will always be available or error-free, though we work to keep it so.
  • To the extent the law allows, we're not liable for indirect or consequential losses (such as travel or accommodation costs), and our total liability for any order is limited to the amount you paid for it. Organizer accounts: limited to fees paid to us in the last 12 months.
  • Nothing in these terms limits rights you have under consumer protection law that can't be waived.

9. Disputes and governing law

Tell us about a problem first at contact@mytooq.,com and we'll try to sort it out. These terms are governed by the laws of The Province of Alberta and the federal laws of Canada that apply there.

10. Changes to these terms

We may update these terms. The version in effect when you buy applies to that purchase. For Organizers, we'll give 15 days' notice of material changes by email or in the dashboard.
